Should I sue the RAC? ALL HPI checks are in doubt!

Regarding this thread [LINK] I called up HPI to complain to them for the giving me wholly the wrong information. They blamed the RAC. I called the RAC who gave me the report, and they said they'd listen to the original call. Anyway they called me back and they've admitted that they're at fault pending an investigation to be completed on monday. They want to give me my £40 back for the HPI check. Am I correct in thinking I could persue them for the (cost of a similar spec t5r) minus (what i was going to pay for this one)? As this would be the additional cost incurred by myself as a cause of the mistake by the RAC. I don't want to buy a T5R first and then find out they won't give me the £2-3000 difference! Is anyone else of the opinion that it is wrong for the RAC to give out the wrong information and simply reimburse the customer? Otherwise how could you trust what they said? I would appreciate any thoughts on this matter as I may be pursuing them in court. :frown: Thanks lovely people! Martin

Doubt it mate, sorry. You would be able to sue them if they gave it a clean bill of health and it then turned out to be a duffer but not, AFAIK, if they say it's a duffer and then it subsequently turns out to be a minter. Regards Andy

I doubt that you could do out - they usually have a get out clause that says something along the lines of "all information given and received is done so as a best effort service we can not take responsibility for incorrect blah blah blah..."

You can't possibly sue for what you might have spent, only for what you did spend including any out of pocket stuff and compensation for the time/agravation.. or did I read this wrong? I would take the refund and nhext time do HPI/look myself and have an independant check if in doubt..

Hmmn so could I get away with saying that The RAC prevented me from buying this car, therefore the RAC have cost me the ownership of the vehicle as it was their mistake that prevented me from buying it. To make ammends, they should provide the cost difference (if any) for a same-specification vehicle, so I can purchase it and be in the same situation that I would have been if they had dealt with my request correctly. ? No you cant mate....they made a mistake and have refunded you what you paid for them. Unless you bought the car AND the information was wrong AND the car turned out to be dodgey, only then will you get a payout. Suprised they got it wrong though...unless you only did a number plate check. As for the suing bit...sorry although very understandably you must be feeling wronged and upset this sounds gold digging and one of the reasons society is increaseingly going the way of the states in litigation. Maybe thinking differently would help..as in if it was meant to be then it was meant to be..
