Hi all,
My daughter bought an 11 plate 70k mile Renault Scenic 1.5 diesel from a local dealer earlier in the week for £6k.
She traded in her 56 plate Smax and got £4600, which she was pretty happy with, unfortunately after bringing it around to us to show it off, the next time she fired it up ESP and Engine Management Lights threw themselves up, the EML telling her not to drive the car, a bit of a pixxer when she is semi-rural with three kids and no other form of transport.
The garage have offered to have the codes read and if economically viable, repair it. They have also provided her with a courtesy car, which all told is the response I would have liked.
The problem is, my daughter has lost faith in the car and really doesn't want it back, so the question is, can she reject it as unfit for purpose or is she obliged to allow them to effect a repair and take it from there.
I remember reading somewhere that if you let the m repair the car and further faults come to light your ability to reject the car becomes further dilute the longer it goes on.
I am sorry to pose such a question after a long week at work but any advice, as always would be gratefully accepted.

Yes, as she has had it for only a matter of days and the car was presumably described as without any major fault when sold, she has the right to reject it as unsatisfactory under the Sale of Goods Act and get a refund. She is only obliged to accept a replacement or repair after a reasonable time has elapsed. Sounds like the garage are trying to be helpful, but it's best to make her position clear before they attempt any repairs.

Word to the wise.....Unfortunately the 11 plate Renault that your daughter bought has a DPF (Diesel Particulate Filter) on it, whereas the 56 plate Smax doesn't. Fact is, if she bought the Renault because she wants reliability and she does mostly short journeys (school runs) and using it to go shopping, then she's bought the wrong car!
She's got to allow the garage to fix the fault but I'd be very interested to know exactly what the fault is. Shame. Whilst I don't like 7 seaters, the Smax IMHO is a much better car than the newer Renault.

Thanks for all the replies guys, it appears we will never know exactly what the problem is as they have agreed to a full refund.
Thanks for your info Lee re the DPF, which I have passed on. The Scenic was one of only a few that would accommodate three child seats across the back, so if she intends to go for another I will suggest she goes for the petrol model.

That's a result then! Second chance to buy a better car and take other factors into consideration.
I hope she chooses wisely this time and gets a petrol. Newer diesels don't like short journeys and will always be unreliable. Plus, petrol is cheaper!

That's exactly what I said to her Lee but she got it into her head that when her current warranty expired next month then so would the Smax.
A suggestion that she took out a further warranty and stuck with a car that she new the history of, particularly since the known faults such as the steering rack and pump and exhaust manifold had already been done, was also treated with distain.
